Sue the bastards!

Yet another gaming, class action, lawsuit has appeared.  Apparently there are some people out their who are particularly miffed that their consoles were locked out and their xbox live accounts banned right when Modern Warfare 2 hit the shelves.

The lawsuit is claiming that Microsoft benefitted from numerous subscriptions to their live service in response to the release of Modern Warfare 2 and other popular holiday titles, and purposely withheld the bans until users renewed their subscriptions to take advantage of the new games.  The lawsuit goes on to add that the ban affects more than the Live service, including Netflix, and downloadable content.

Microsoft has not yet commented, but I would expect them to point out that these users have violated the terms of service of both the Xbox, and Xbox Live.  As such they entered into a de facto contract and that contract expired when the users modified their hardware.  Of course, the terms of service are so water tight that simply adding a new light, or spray-painting it orange could also violate the terms and service agreement.  Not a lot of people complaining their xbox was shut down because they drew a skull with a sharpie on the front panel.
